North American Auctioneers (“North American Auctioneers,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains what we collect, how we use and share it, and the choices and rights available to you.

This policy applies to your use of our website, accounts, emails, applications, events, and all related features, products, and tools (collectively, the “Services”), regardless of how you access them (including mobile and apps).

Please read this policy carefully. It tells you who we are, what data we collect, how and why we process it, how long we keep it, who we share it with, and how to contact us or a regulator if you have concerns.


1) Who We Are

North American Auctioneers provides online auction, private sale, and related services for properties and real estate. We collect and process personal information in connection with providing the Services.

Depending on where you live, data protection laws may give you specific rights. If you are in the European Economic Area (EEA) or UK, we act as a “controller” under the GDPR/UK GDPR. If you are in Canada, we handle personal information per applicable laws such as PIPEDA. If you are in the United States (including California), you may have rights under state laws such as the CCPA/CPRA.

2) What We Collect and How We Use It

We collect information you provide directly, information created during your use of the Services, and information from third parties (e.g., identity verification providers, payment processors, marketing platforms).

Categories of data we may collect:

  • Identity Data – name, username, government ID (where legally required), date of birth, and images/video captured at our events.

  • Contact Data – mailing address, email address, phone number.

  • Property & Transaction Data – property details you submit for listing, bids/offers you make, purchase/sale records, closing details we facilitate or support, communications related to a transaction.

  • Financial Data – payment method details (processed by our payment processor), bank/account info for payouts and refunds.

  • Technical Data – IP address, device and browser info, time zone, operating system, app version, cookies and similar technologies.

  • Profile & Usage Data – account credentials, preferences, saved searches, watchlists, feedback/surveys, how you use the Services.

  • Marketing & Communications – your marketing preferences and correspondence with us.

  • Verification/Compliance Data – results of KYC/AML screens, sanctions and PEP checks where required by law.

We also use Aggregated Data (statistical summaries that don’t identify you). If we combine Aggregated Data with personal data, we treat the combined data as personal data.


3) Legal Bases / Why We Process Your Data

We process your personal information when one or more of the following apply:

  • Consent – you’ve given clear consent (e.g., certain marketing).

  • Contract – to provide the Services you requested (e.g., create an account, list a property, place bids, complete transactions).

  • Legal Obligation – to meet legal, regulatory, tax, KYC/AML, or reporting obligations.

  • Legitimate Interests – to operate, improve, and secure our Services; prevent fraud; support users; and grow our business, provided these interests are not overridden by your rights.


4) How We Use Your Information

We use your information to:

  • Run promotions, events, and surveys (Identity, Contact, Profile, Usage) — Contract; Legitimate Interests; Consent where applicable

5) Sharing Your Information

We do not sell your personal information. We share it only as needed:

  • Within our corporate group to provide and improve the Services.

  • Payment processors to take payments and make payouts.

  • Identity/KYC/AML providers to verify identity and comply with law.

  • Real estate professionals and service providers you engage or that are necessary to facilitate a transaction (e.g., property photographers, listing coordinators, licensed brokers where applicable, title/escrow companies, attorneys, inspectors, notaries, shipping/records couriers).

  • Advertising and analytics partners (only as permitted) to measure and improve our marketing.

  • IT, hosting, customer support, and security vendors who process data on our behalf under contract.

  • Law enforcement, regulators, or parties to legal proceedings where required by law or to protect rights, property, and safety.

  • Business transfers (e.g., merger, acquisition). We will continue to protect personal data per this policy or notify you of changes.

We disclose only the minimum personal information necessary for the intended purpose and require recipients to protect it.


6) Cookies and Similar Technologies

We use cookies and similar technologies to operate the site, keep you signed in, remember preferences, analyze traffic, and personalize content/ads (where permitted). You can manage cookies through your browser/device settings. Some features may not work without certain cookies.


7) Marketing

With your consent (where required), we may send you newsletters, updates, event invitations, and promotional content. You can opt out at any time by clicking unsubscribe in our emails or contacting auction@execulink.com. Transactional and service messages will still be sent.


8) International Data Transfers

We may transfer your personal information to other countries (including Canada, the United States, the United Kingdom, and the EEA). When we do, we use appropriate safeguards required by applicable law (e.g., standard contractual clauses, adequacy decisions) and ensure your rights remain protected.


9) How Long We Keep Your Data

We retain personal information only as long as necessary to provide the Services and for legitimate business or legal purposes, including to:

  • respond to questions or complaints;

  • maintain records required by law, tax, or audit;

  • comply with KYC/AML and other regulatory obligations;

  • establish, exercise, or defend legal claims.

Retention periods vary by data type and legal requirements.


10) Your Privacy Rights

Your rights depend on where you live. Subject to limits under applicable law, you may have the right to:

  • Access the personal information we hold about you;

  • Correct inaccurate or incomplete personal information;

  • Delete/Erase your personal information;

  • Port your data in a machine-readable format;

  • Object to or restrict processing (including objections to direct marketing);

  • Withdraw consent where processing is based on consent;

  • Appeal our decision if we decline a request (where required by law).

Ontario 

Ontario residents may also have the right to:

  • request to know categories and specific pieces of personal information we collected;

  • request deletion;

  • request correction;

  • opt out of “sale” or “sharing” for cross-context behavioral advertising (we do not sell personal information, and we only share for advertising with your permission as permitted by law);

  • limit use and disclosure of sensitive personal information (we use sensitive information only as allowed by law to provide the Services, verify identity, secure accounts, and comply with obligations).

We will not discriminate against you for exercising your rights.

Canada (PIPEDA and provincial laws)

You may request access and correction, and to withdraw consent where processing is based on consent. If we refuse a request, we’ll provide the reason (unless prohibited by law).

  • sufficient details to identify you and your request; and

  • proof of identity and address (e.g., driver’s license or passport and a recent utility bill).
    We will respond within the timelines required by law.


11) Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. Access is limited to personnel and service providers with a business need and subject to confidentiality obligations. If we become aware of a data breach, we will notify you and regulators as required by law.


12) Children’s Privacy

Our Services are not intended for individuals under the age of majority in their jurisdiction (or under 16 where consent rules differ). We do not knowingly collect personal information from minors without appropriate consent.

We may update this Privacy Policy from time to time. The “Last updated” date at the top tells you when we last changed it. If changes are material, we’ll provide additional notice where required.
